Terms & Conditions

These Terms govern your access to and use of the Whistly platform. By accessing or using Whistly, you agree to be bound by these Terms.

These Terms and Conditions (“Terms”) govern your access to and use of the Whistly platform (“Service”). By accessing or using Whistly, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old to use Whistly. By using the Service, you confirm that you meet this requirement.

2. Account Registration

  • Each account must use a unique email and phone number
  • Users may register as either a coach or a client
  • You are responsible for maintaining account security
  • You agree to provide accurate and up-to-date information

3. Role Definitions

  • Coaches provide fitness programs and guidance
  • Clients receive fitness programs from coaches or AI
  • Whistly is a technology platform and not a medical provider

4. AI Coach Disclaimer

AI coaching is provided for fitness guidance only. It does NOT:

  • Replace medical advice
  • Diagnose conditions
  • Guarantee results

Use AI coaching at your own discretion.

5. Payments & Subscriptions

  • Subscription fees are billed in advance
  • Coaches set their own pricing
  • Whistly charges a platform service fee
  • All fees are non-refundable unless stated otherwise
  • Failed payments may result in restricted access

6. Referrals & Rewards

  • Referral rewards apply only to eligible first-time payments
  • Points and rewards may expire
  • Whistly reserves the right to modify reward rules

7. User Content

You retain ownership of content you upload.

By uploading content, you grant Whistly a limited license to store and display it as part of the Service.

You must not upload:

  • Illegal content
  • Harmful or abusive material
  • Content violating others’ rights

8. Acceptable Use

You agree NOT to:

  • Misuse the platform
  • Attempt unauthorized access
  • Harass or abuse others
  • Circumvent subscription limits
  • Reverse engineer the platform

9. Termination

We may suspend or terminate accounts if:

  • Terms are violated
  • Fraud or abuse is detected
  • Required by law

Users may terminate their account at any time.

10. Disclaimers

Whistly is provided “as is” without warranties of any kind. Results from fitness programs are not guaranteed.

11. Limitation of Liability

Whistly shall not be liable for injuries or health issues, loss of data, loss of income or business, or indirect or consequential damages.

12. Indemnification

You agree to indemnify and hold Whistly harmless from claims arising from your use of the Service.

13. Modifications to Terms

We may update these Terms at any time. Continued use of Whistly means acceptance of updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India.
